Our physical, electronic, and managerial procedures have been employed to safeguard the security and integrity of personal information. Billing information is encrypted whenever transmitted or received online. Personal information is only accessed by our staff designated to handle requests, questions, and complaints. All of our staff members with access to personal information obtained on our website are also bound to adhere to this policy. We will not use your personal information for any purpose other than that for which it is submitted. We use personal information to reply to inquiries, requests, complaints, provide operational notices, and bookkeeping. We do not sell, trade or rent your personal information to any other party.
License Terms and Conditions - Rights Managed and Royalty Free Images
WesternStockPhotos.com has been designed to provide affordable Rights Managed and Royalty Free images for advertising and editorial use. Rights Managed images or content is licensed for a specific predefined use and the usage fees are based on the usage needed. Royalty Free images or content is licensed for non-exclusive use of an image for a one-time flat fee.
The following terms and conditions apply to both Rights Managed and Royalty Free images. All licenses granted by WesternStockPhotos.com and Matthew Idler Photography must first be agreed upon before purchase with the following agreement.
All images on this website are copyrighted and cannot be used without a usage license, payment, and agreement of usage terms. Image, image rights, and copyright, remain sole and exclusive property of the creator, photographer, or artist. When purchasing an image license, you are purchasing a license to use the image for a specific usage and period of time.
Permitted Uses - Rights Managed and Royalty Free Images
1. The license is Non-exclusive and is available on our website for others to purchase. If you require exclusive use of any stock image, you must purchase it under different license terms, please email us with your requirements. Once an exclusive license is purchased, we will remove it from our library.
2. The image or images may be installed and used on only one computer at a time. You may create one (1) copy of the image or images solely for back-up purposes, and you must store a copy of all licensing documents with the image or images on your backup.
Un-permitted Uses - Rights Managed and Royalty Free Images
1. The image or images are Non-transferable, the license is valid for the purchaser only. The image or images cannot be sold, resold, transferred, gifted, rented, sub-licensed, assigned, lended, or distributed to anyone else.
2. The image or images cannot be used in any kind of product that allows the image to be copied, re-used, re-distributed, or extracted, such as a web template or electronic greeting card.
3. The image or images cannot be used or displayed in any content that features the model, person, or people in a manner that would lead a reasonable person to think that the person, people, or subjects endorses any product, service, business, association, cause, or other endeavor.
4. The image or images cannot be used or displayed in any content that features the model, person, people, or subject in a manner that depicts such person or subject in a potentially sensitive subject matter, including, but not limited to political issues, rights, animal right issues, social issues, mental and physical health issues, implied sexual preferences, implied sexual activities, crime, substance abuse, physical or mental abuse, or any subject matter that would be offensive, unflattering, or embarrassing to the person, people, or subject in the image.
5. The image or images cannot be used or displayed in any way that shows, displays, or depicts agriculture, livestock, cowboys, or western life, in a negative or offensive way.
6. The image or images cannot be used or displayed in any manner that depicts the person, people, subject, or property in an obscene, pornographic, immoral, infringing, or damaging manner.
7. The image metadata, including copyright, and creators information cannot be removed from any image.
8. The image or images cannot be stored or duplicated to multiple locations, distributed on web servers, network servers, mobile devices, email, file sharing or anywhere that other users can use, download, or distribute.
9. The image or images cannot be used for editorial use without including a copyright similar to ©westernstockphotos.com or artists' name (© Matthew Idler). The artists' name can be found in the File Info window in Photoshop.
Royalty Free Web and Print License Terms and Conditions
Upon full payment of a license fee, Matthew Idler Photography and Westernstockphoto.com grants a perpetual, non-exclusive, non-transferable worldwide license to use the selected image or images for the Permitted Uses (see below). All other image rights and copyright, remain sole and exclusive property of the creator, photographer, or artist.
Permitted Uses - Royalty Free Web and Print License
1. The image or images can be reproduced up to 250,000 times anywhere in the world. You may also use the image or images as long as you wish, just as long as you do not exceed 250,000 reproductions. Please email us if this reproduction limit does not exceed your use and we can create an extended reproduction limit at a discounted price.
2. The image or images may be used in advertising and promotional projects, including presentations, printed materials, posters and prints (not for resale), product packaging, commercials, catalogs, brochures, promotional greeting cards, promotional postcards, annual reports, film and video presentations.
3. The image or images may be used in entertainment applications or publications including books, book covers, magazines, editorials, newspapers, newsletters, video presentations, broadcast presentations, and theatrical presentations.
4. Images may be used on the web, but these images can only be used on one domain (i.e. www.yourdomainname.com); the images can be used on as many web pages within the domain as you desire. The image or images may also be altered for the Web if needed, but they cannot be included in any design that is resold.
Un-permitted Uses - Royalty Free Web and Print License
1. The image or images cannot be used in products for resale, license, or other distribution such as a t-shirts, mugs, greeting cards, postcards, posters, prints, paper (watercolor, canvas) or any other media. The image or images cannot be printed and used for resale or distribution for profit.
2. The image or images cannot be used in any type of web design template, website template, design template, flash template, business template or any other media intended for resale. You may not use the image or images on more then one website domain (i.e. www.yourdomainname.com). The image or images can be used on as many web pages within that domain as you desire. An image can be altered if necessary, but the image or images cannot be included in any composite that is resold.
3. The image or images cannot be used in or part of a trademark, trade name, business name, design-mark, or service mark.
4. The image or images cannot be used more then 250,000 times, the image cannot be reproduced more then 250,000 times. The image can only be used up to 250,000 times including print runs and circulation. Please notify us if you will exceed reproduction of 250,000 and we can give you an extended license at a discounted price.
Rights Managed Print License Terms and Conditions
1. The image or images may be used for a specific use only, pre-defined when ordered. Upon full payment of the license fee, you are granted a Limited, Non-transferable, Non-exclusive, pre-defined usage license. The license is available on our website for others to purchase. If you require exclusive use of any stock image, you must purchase it under different license terms, please email us with your requests and needs.
2. Upon full payment of the license fee, you are granted a license for a SPECIFIC USE ONLY- this means that you can use the image for one type of publication or one use, predefined when you order. Images with a Rights Managed License are priced specifically for a type of use, size, circulation, and duration of use.
Image License Customization to Match Your Needs
If there is a license that you need, and it is not available above or in the rights managed image collection, we can provide it for you. Please email us with all your stock image needs, and we can put a license agreement together.
For example: we can create an extended royalty free license exceeding our reproduction limit of 250,000 or create an extended license allowing you to resell or distribute our images in your products.
Sample Images and Comp Terms and Conditions
1. Comps are available for mockup and layout purposes only.
2. Comps are solely for layout evaluation to determine what size and usage license is needed.
3. Comps cannot be copied, published, distributed, or displayed without a license.
4. Sample images or comps must be destroyed after 60 days of the download if a license is not purchased.
Image Prints Terms and Conditions
Image prints are also available and can be ordered directly from our site. Prints cannot be reproduced, copied, or resold and are available for display only.
